These Terms govern use of thelightco.com.au and orders placed through our online store. They should be read with our delivery, returns and privacy policies.

These Terms of Service (“Terms”) apply to the website thelightco.com.au and purchases made from The Light Co. The website is operated by NORFIELD VENTURES LTD, whose registered office is 125 Deansgate, Manchester, England, M3 2BY. By using the website or placing an order, you agree to these Terms. If you are purchasing as a consumer in Australia, these Terms operate in addition to rights and remedies that cannot be excluded under the Australian Consumer Law.

“The Light Co”, “we”, “us” and “our” refer to NORFIELD VENTURES LTD as the operator of thelightco.com.au. “You” means a visitor, customer or other person using the website.

The registered office is not a retail showroom or return address. Contact us before returning a product or sending correspondence that requires special handling.

Online Store Use

Eligibility, Accounts and Accurate Information

You must have legal capacity to enter into a contract or use the website with the involvement of a parent, guardian or authorised representative.

You are responsible for providing complete and accurate account, contact, billing and delivery information. You must keep account credentials confidential and notify us if you reasonably suspect unauthorised use.

You must not use another person's information without authority, create accounts for fraudulent purposes or interfere with website security.

Products

Descriptions, Images and Suitability

We aim to present product descriptions, dimensions, colours, finishes, features and images accurately. Screen settings, photography and lighting can affect how colours and finishes appear.

Before ordering, review the complete product page and confirm that the item is suitable for your intended space and use. For electrical products, check the listed voltage, plug type, power source, installation method and any other compatibility information.

Hardwired products must be assessed and installed by an appropriately licensed electrician. This requirement does not remove our obligations regarding product safety, description or consumer guarantees.

Brand information: A product's style or appearance should not be understood as evidence of affiliation, authorisation or endorsement. Any brand relationship will only be stated where it can be supported.

Prices and Taxes

Displayed Prices and Final Checkout Total

Prices are displayed in Australian dollars unless clearly stated otherwise. The total amount payable, including mandatory taxes and delivery charges applied by the store, is displayed at checkout before you submit payment.

Promotional pricing, discounts and shipping offers are subject to the conditions displayed with the offer. We do not apply an additional charge after checkout without your agreement, except where required by law.

If a genuine pricing or technical error is identified before an order is accepted, we may contact you with the correct information and allow you to proceed or cancel. If payment has been taken and the order is cancelled, the amount paid will be refunded.

Orders

Order Placement, Acceptance and Availability

Placing an order through Shopify checkout is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted.

An order is accepted when we send an acceptance or dispatch confirmation, or when we otherwise confirm fulfilment. Before acceptance, we may decline or cancel an order for a genuine reason, including unavailable stock, delivery restrictions, an obvious pricing error or a reasonable fraud or security concern.

If we cancel an order after payment has been taken, we will refund the amount paid. If we cannot supply an accepted order on time or within a reasonable time, we will provide an appropriate solution in accordance with applicable law.

Payment

Shopify Checkout and Payment Authorisation

Payment methods available for your order are displayed at checkout. Payment processing is provided by Shopify and the relevant payment provider.

You confirm that you are authorised to use the selected payment method and that the payment information supplied is accurate. Orders may be subject to payment authorisation, fraud-prevention and security checks.

We do not intentionally store complete payment card numbers on systems controlled directly by us. Do not send full card details through email or our contact form.

Delivery

Processing, Tracking and Risk

Delivery options, charges, processing information and estimated timing are governed by our Shipping & Delivery Policy. Delivery estimates are not guaranteed unless we expressly agree to a guaranteed date in writing.

Products may be dispatched from different fulfilment locations, including locations outside Australia. An order may arrive in more than one parcel.

For consumer orders, risk of loss or damage generally remains with us until the product is delivered to you or to a person or safe location authorised by you, subject to applicable law and carrier arrangements.

You are responsible for checking the delivery address before completing checkout and for providing reasonable access and delivery instructions.

Returns and Cancellations

Change of Mind, Faults and Order Changes

Our voluntary change-of-mind return conditions and the procedure for damaged, faulty or incorrect products are explained in our Returns & Refund Policy.

Contact us as soon as possible to request an order change or cancellation. We will try to assist, but a change or cancellation cannot be guaranteed after processing or dispatch has begun.

Nothing in our policies excludes rights and remedies that cannot be excluded under the Australian Consumer Law.

Consumer Guarantees

Your Rights Under Australian Consumer Law

Goods supplied to consumers in Australia come with consumer guarantees that cannot be excluded. These include guarantees that goods are of acceptable quality, match their description and are reasonably fit for any disclosed purpose.

The remedy available for a product problem depends on whether the failure is major or minor and on the circumstances. Remedies may include repair, replacement, refund or compensation for reasonably foreseeable loss.

Any manufacturer or voluntary warranty is additional to, and does not replace, rights under the Australian Consumer Law.

Promotions

Discount Codes, Gift Cards and Offers

Promotional codes, gift cards and special offers are subject to the conditions displayed with them. Unless expressly stated otherwise:

  • Only one promotional code may be applied to an order
  • A code cannot be exchanged for cash
  • A code may exclude particular products, collections or delivery charges
  • A minimum purchase amount may apply
  • Offers cannot be applied retrospectively to completed orders

We may refuse use of a code where it has expired, does not satisfy its published conditions or has been obtained or used fraudulently.

Business and Larger Orders

Separate Written Terms May Apply

Customers may contact us about larger quantities or business purchases. Availability, price, delivery and any special conditions must be confirmed in writing for the relevant order.

We do not promise wholesale pricing, credit terms, exclusivity, custom manufacturing or private-label services unless expressly agreed in a separate written agreement.

Mandatory protections for eligible small-business standard-form contracts continue to apply where required by Australian law.

Intellectual Property

Website Content and Permitted Use

Website content, including text, layout, graphics, photographs and logos, is owned by us or used with permission and is protected by applicable intellectual property laws.

You may access and use the website for personal shopping and legitimate business enquiries. You must not reproduce, republish, sell, scrape or commercially exploit website content without permission, except where permitted by law.

Third-party trade marks remain the property of their respective owners. Their appearance does not by itself indicate a relationship with us.

Liability

Limits That Apply Only Where Law Permits

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

To the extent permitted by law, we are not responsible for loss caused by your misuse of a product, failure to follow instructions, unauthorised modification, unsuitable installation or use outside the product's stated purpose.

We are not responsible for indirect or consequential loss where excluding that loss is lawful. This clause does not exclude liability for fraud, personal injury caused by negligence, or another liability that cannot be excluded.

Events Outside Reasonable Control

Delays and Disruptions

We are not responsible for delay caused by events outside our reasonable control, such as severe weather, natural disasters, carrier disruption, industrial action, government restrictions, border or customs disruption, major system outages or supplier interruption.

We will take reasonable steps to reduce the effect of a disruption and provide updated information where practicable. This clause does not remove any right to a refund or other remedy where goods cannot be supplied within an agreed or reasonable time.

Personal Information

Personal information is handled as described in our Privacy Policy. By using the website, you acknowledge that information will be processed as reasonably necessary to operate the store, process orders and provide support.

Marketing communications can be unsubscribed from using the link in the message or by contacting us.

Complaints and Disputes

Contact us at info@thelightco.com.au with your order number and a clear description of the issue. We will review the matter and aim to work towards a reasonable resolution.

Nothing in these Terms requires a consumer to give up a right to contact a consumer protection agency, payment provider, court or tribunal with jurisdiction.

Governing Law

Applicable Law and Consumer Rights

These Terms are governed by the laws of England and Wales, because the website operator is registered in England. However, this choice of law does not exclude mandatory rights or protections that apply to a consumer in Australia, including rights under the Australian Consumer Law.

A consumer may bring a claim in any court or tribunal that has jurisdiction under applicable law.

General

Severability, Waiver and Changes

If part of these Terms is found unlawful or unenforceable, that part will be read down or removed to the minimum extent necessary, and the remaining provisions will continue.

A delay in enforcing a right does not waive that right. You may not transfer your rights under an order without our consent, except where the law permits. We may transfer our rights and obligations as part of a genuine business transfer, provided this does not reduce your legal rights.

We may update these Terms for future website use and future orders. The version applying to an order is generally the version published when the order was placed, unless a change is required by law or agreed with you.
